MORPHEUS RENTALS – TERMS AND CONDITIONS

1. ABOUT US
These Terms and Conditions apply to all equipment hire services provided by Morpheus Rentals (“Company”, “we”, “us”).
By placing a booking, you (“Client”, “you”) agree to be bound by these Terms.
2. DEFINITIONS
In these Terms:
“Equipment” means all items listed in the Invoice or Packing List
“Hire Period” means the agreed rental period
“Invoice” means the booking confirmation issued by the Company
“Packing List” means the document listing supplied Equipment
“Agreement” means these Terms and the Invoice together
“Authorised Courier” means a delivery provider approved or arranged by the Company
3. BOOKINGS, PAYMENT & VERIFICATION
3.1 All bookings are subject to availability and confirmation.
3.2 Full payment must be made prior to the start of the Hire Period unless otherwise agreed in writing.
3.3 We reserve the right to refuse release of Equipment until payment is received in full.
3.4 You authorise us to charge your payment method for:
Damage or loss
Late returns
Additional agreed charges
Recovery and administrative costs
3.5 We will provide reasonable notice and evidence for additional charges.
3.6 Identity Verification
3.6.1 We reserve the right to request:
Photo ID
Proof of address
Additional verification
3.6.2 Failure to provide verification may result in cancellation without liability.
3.6.3 We reserve the right to refuse or cancel any booking at our discretion.
4. CANCELLATION POLICY
4.1 Cancellation terms are as stated at the time of booking.
4.2 Charges may apply depending on the notice period given.
4.3 Bookings cancelled within 48 hours of the Hire Period may be charged up to 100% of the hire fee.
4.4 No refunds may be issued once the Hire Period has commenced.
4.5 The Company reserves the right to cancel bookings where necessary.
5. DELIVERY, COLLECTION & ACCEPTANCE
5.1 Equipment will be delivered or made available for collection as agreed.
5.2 You are responsible for:
Providing safe, accurate, and timely access for couriers
Ensuring availability for delivery and collection
5.3 Failed delivery or collection due to lack of access may result in additional charges.
5.4 You must inspect Equipment within 24 hours of receipt.
5.5 Any issues must be reported within this period.
5.6 If no issues are reported, Equipment is deemed accepted.
5.7 Proof of Delivery & Collection
5.7.1 Proof of delivery or collection shall include:
Courier tracking confirmation
Delivery or collection scan
Signature or photographic evidence
5.7.2 Such evidence shall be considered conclusive proof of delivery or return.
6. USE OF EQUIPMENT
6.1 You agree to:
Use Equipment properly and safely
Follow all instructions
Not modify or tamper with Equipment
6.2 Equipment must not be sub-hired without written consent.
6.3 You must keep Equipment secure at all times.
7. RISK, LOSS & DAMAGE
7.1 Risk passes to you upon delivery or collection.
7.2 You remain responsible until Equipment is:
Collected by an Authorised Courier, and
Confirmed via tracking or collection scan
7.3 You are responsible for:
Loss
Theft
Damage (excluding fair wear and tear)
7.4 You must report issues immediately.
7.5 You are liable for:
Repair costs; or
Full replacement value
7.6 If Equipment is not returned, you are liable for:
Recovery costs
Legal fees
Associated losses
8. SECURITY DEPOSIT & DAMAGE WAIVER
8.1 First-Time Clients
A refundable security deposit of £250 is required.
8.2 Deposits:
Are held during the Hire Period
Returned within 5–10 working days after inspection
May be used to cover damage, loss, or charges
8.3 Returning Clients – Damage Waiver Option
Returning clients may be offered a 25% damage waiver fee.
8.4 The damage waiver:
Is non-refundable
Does not remove responsibility for Equipment
8.5 IMPORTANT
The damage waiver does not cap liability and any reduction is discretionary.
8.6 The waiver does not cover:
Theft or loss
Negligence
Misuse
Breach of terms
8.7 We may refuse the waiver and require a deposit at any time.
9. LATE RETURNS
9.1 Equipment must be returned on time.
9.2 Late returns are charged at 2× the daily hire rate per day (or part day).
9.3 Charges reflect:
Loss of use
Disruption
Administrative costs
9.4 Charges continue until return or replacement.
9.5 After 48 hours, Equipment may be treated as lost.
9.6 We may recover Equipment without notice.
9.7 Charges may be applied proportionately where appropriate.
10. INSURANCE
10.1 You may be required to insure Equipment.
10.2 Proof may be requested.
10.3 Without insurance, you accept full liability.
11. DATA PROTECTION & TRACKING
11.1 We process data in accordance with the UK GDPR.
11.2 We may collect:
Contact details
Identification
Transaction data
11.3 Identification is:
Used only for verification
Not retained physically
Securely deleted
11.4 You have rights including access and deletion.
11.5 Complaints can be made to the Information Commissioner's Office.
11.6 Tracking Technology
11.6.1 Equipment and/or parcels may contain tracking technology (e.g. GPS).
11.6.2 This is used for:
Asset protection
Theft prevention
Logistics
11.6.3 By agreeing, you consent to this use.
11.6.4 Tracking will not be used for personal surveillance.
11.6.5 Any tampering with tracking devices:
Is strictly prohibited
May result in immediate liability for full replacement value
11.6.6 Tracking data may be used as evidence in disputes or recovery actions.
12. LIABILITY
12.1 Our liability is limited to the hire fee paid.
12.2 We are not liable for:
Indirect or consequential loss
Business losses
12.3 Nothing excludes liability for:
Death or personal injury
Fraud
13. FORCE MAJEURE
13.1 We are not liable for events beyond our control.
14. TERMINATION
14.1 We may terminate if:
Terms are breached
Payment fails
Equipment is at risk
14.2 Equipment must be returned immediately.
15. GENERAL
15.1 This Agreement is the entire agreement.
15.2 Changes must be in writing.
15.3 Invalid clauses do not affect the rest.
15.4 Governed by the laws of England and Wales.
15.5 Courts of England and Wales have jurisdiction.
